NEW YORK, NY, March 14, 2025 - BPI issued the following statement in response to California Governor Gavin Newsom’s directive to CalRecycle to restart the regulatory process for SB 54:
BPI remains supportive of SB 54 and its goal to ensure that all products in California are reusable, recyclable, or compostable. While delaying the rulemaking process complicates the timeline for implementation, we hope this directive creates an opportunity to improve regulation text that we feel has failed to actualize legislative intent of the bill in important ways. We also hope the delay provides the impetus for granting the other much needed action of an extension on the AB 1201 requirement, so that compostable products aren’t eliminated from California in 9 months.
SB 54 provided a clear mandate to create a compliance pathway for compostable products, defined in California law based on independent verification of globally recognized standards. We sincerely hope this restart builds off statutory definitions, creates requirements with adherence and clear standards, and considers the science and safety of disintegration and biodegradation. This will lead to clear and aligned rules Californians deserve.
